On January 4, 2022, a majority of CTU members voted to exercise their right not to work in an unsafe workplace and to return to work remotely until the district has implemented an appropriate COVID-19 testing program to detect those infected during the current wave or until the number of infections falls below the parameters set on 24 February. Before the working day could start on 5 January 2022, the EPC cancelled classes and locked out bargaining unit members by preventing them from working remotely. This lockout violates Sections 14(a)(l), (a)(3) and 14(a)(5). The lockout also violates the parties` collective agreement. In addition, the county`s requirement that employees report to work without providing safe and healthy working conditions constitutes a rejection of the essential elements of the collective agreement that violates Section 14(a)(l) and (5). On 24 August, the EPC published a document entitled “Fall Opening: The Parent, Educator and External Partner Guide” (`CBE Fall Opening Guide`). The CBE Fall Opening Guide unilaterally announced and imposed new conditions that affect the working conditions and personal safety of bargaining unit staff, including health protocols, student cohorts, contact tracing, Covid-19 testing, social distancing, quarantine protocols, exemptions from face covering requirements, and teachers` obligation to teach students who are in person and online at the same time.
